These General Conditions regulate the purchase of the products offered through the website www.empordalia.com

In this document we will refer to the “User”, which is the natural person who inquires about and/or buys the product offered by www.empordalia.com, and to “EMPORDÀLIA”, which is us.

The User must read and accept these General Conditions before proceeding with their purchase. This acceptance will be made expressly by clicking on the “I have read and accept the General Conditions” box that will appear during the purchase process. By doing so, the user confirms that he is of legal age and has the legal capacity to purchase the product offered by EMPORDÀLIA.

At the moment of formalizing the purchase, it will be understood as perfected in full and from that moment the prices and conditions will have a contractual nature, so they can only be modified by the express agreement of the contracting parties.

The language used to formalize the contract will be Spanish.

The electronic document in which the contract is formalized will be archived for one year and the User will have access to it in their customer area or by requesting a copy by email to EMPORDÀLIA.

OBLIGATIONS OF THE USER:

The user undertakes in general to use www.empordalia.com, and where applicable, to purchase the products offered by EMPORDÀLIA in accordance with the law and the provisions of these General Conditions.

EMPORDÀLIA reserves the right to delete from www.empordalia.com any comments or opinions of users that are contrary to current law, especially in cases that violate the rights and fundamental freedoms of people.

PURCHASE PROCEDURE AND PAYMENT FOR PRODUCTS:

The User will select on the www.empordalia.com website the product they wish to purchase and the number of units.

The user must fill in the form with their data to be able to process the order, being able to also register as a web user to be able to track their orders, and must expressly accept these General Conditions. The User will be shown a list of the products he wants to purchase and their price, and the user can make the changes he deems appropriate before clicking on the “Pay” section. Once he accesses the “Pay” section, the User must enter the credit card details with which he will make the payment or the details of his Paypal account, and accept the payment.

EMPORDÀLIA will send to the User’s email an email justifying the receipt and confirmation of the purchase made within twenty-four hours (24 hours) following the receipt of the formalization of the order. The contract will not be considered perfected until EMPORDÀLIA receives payment for the price of the products.

If the User wants an invoice, he can obtain it in his customer area or by requesting it by email to EMPORDÀLIA.

The user will be responsible for the veracity of the personal data provided to EMPORDÀLIA for the acquisition of the chosen products, and in particular he/she is responsible that the credit or debit cards he/she uses are his/her own and that they have sufficient funds to cover the cost of the products you want to purchase. EMPORDÀLIA reserves the right to cancel the order in the event of non-payment, chargeback, denied card or false data or in the event that it cannot verify the card data. Likewise, the User must notify EMPORDÀLIA via e-mail of any undue or fraudulent charge to the card used for purchases on the web as soon as he becomes aware of it so that EMPORDÀLIA can act accordingly.

RIGHT OF WITHDRAWAL:

In accordance with Art. 102 of the Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, all products purchased at EMPORDÀLIA can always be returned and reimbursed that the user communicates the intention to return the product(s) within a maximum period of 14 calendar days from the date of delivery.

To exercise the right of withdrawal, the User must notify us of his decision to withdraw from the contract through an unequivocal statement that he can send us by post to EMPORDÀLIA, Ctra. de Roses s/n, 17494 PAU (Girona) or email info@empordalia.com. If you wish, you can use what is at the end of these conditions.

EMPORDÁLIA will only accept returns that meet the following conditions:

The product must be in its original condition, packaging and labeling.
Shipping must be done in the same cardboard box in which the order was received. In the event that it cannot be done with the original protective box, the user must return it in a box that guarantees the protection of the contents so that it arrives at EMPORDÀLIA, in good condition, otherwise EMPORDÀLIA reserves the right the right to refuse the return.
A copy of the invoice must be included in the package, indicating the returned products.
The transport costs incurred by the return will be borne by the user, who can freely choose the company he prefers for the transport of the item, and, if he wishes, perform a calculation of the said cost here:

Once the product has been received and verified that it is in perfect condition, the refund of the amount will be processed, which will be carried out within a maximum period of 14 calendar days from receipt, using the same payment method that the user used choose when placing the order.

NULLITY OF THE CLAUSES:

If any clause included in these General Conditions is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will affect only that clause or the part thereof that is null or ineffective, the rest of the General Conditions.

NOTIFICATIONS:

Any notification or request that the parties must make in relation to the purchase and sale of products or these General Conditions, must be made in writing and will be understood to have been duly made if it has been sent to the email that these effects each party has indicated to the other.

APPLICABLE LEGISLATION AND COMPETENT JURISDICTION:

These General Conditions will be governed and interpreted in accordance with the Laws of Spain. Any dispute that arises in the application or interpretation of these conditions, as well as in existing contracts between the parties, will be resolved in the courts of the city of Figueres, Spain, which will have exclusive jurisdiction over any other jurisdiction, with exception of the provisions of the General Law for the Defense of Consumers and Users, in case this Law is applicable.

EMPORDÀLIA reserves the right to make changes at any time to our website, as well as to these General Conditions.
